The residence permit for pending employment is issued when, at the time of renewal of a residence permit for subordinate work purposes, the worker does not have an employment contract but is registered as a job seeker. Loss of employment is not a reason for the residence permit of the non-EU citizen worker, and has legally residing family members, to be revoked.
The foreign national citizen who loses his/her job following redundancy or dismissal must present him/herself, within 40 days from the cessation of work, to the Employment Centre Registry to declare details on the previous job held and immediate availability to recommence work.
The foreign national citizen who loses his/her job can enrol on the job seekers register at the Employment Centre for the remaining amount of time left on his/her residence permit for a period of not less than one year or in all cases, for the entire duration of the income support service, during which time he/she can look for a new job. This does not apply to seasonal workers.
It is possible to enrol at the Employment Centre even if the residence permit has expired provided that the foreign national citizen has the renewal receipt/slip.
The application for the residence permit for pending employment must be submitted by completing the Post Office “kit” necessary for renewal.
Duration
The relevant Police headquarters (Questura), upon expiration of the residence permit, issues a residence permit for pending employment that has a duration of not less than one year.
Apart from going beyond the expiry date of the residence permit for pending employment, the foreign national who finds a job is authorised to stay in Italy subject to demonstrating a minimum annual income that meets the parametres required for family reunification.
